Reporting Options

 

Service members and their adult military dependents have two reporting options:

 

Restricted Reporting - Member can access confidential services without the notification to command or law enforcement. 

Intended to give the victim additional time and increased control over the release and management of the victim’s personal information, the Restricted Report enables military members in a duty status to report allegations of sexual assault to specified personnel without triggering an investigation. Specified personnel include the SARC, Healthcare Personnel, trained Victim Advocate or Chaplain. Other elements of the Restricted Report include: Complete confidentiality, Access to medical care, counseling and a victim advocate. Empowers the victim to seek relevant information and support to make an informed decision about participating in the criminal process.

Unrestricted Reporting- Member can access services and both the command and law enforcement are notified. 

An unrestricted report is any report of a sexual assault made through normal reporting channels which includes the victim’s chain of command, law enforcement, and the criminal investigative service. The SARC will be notified and assign a victim advocate to the individual. Details of the allegation will be provided only to those personnel who have a legitimate need to know.

Sexual Assault Defined

Sexual Assault- intentional sexual contact by use of force, threats, intimidation, or abuse of authority, or when the victim does not or cannot consent.  Includes rape, aggravated sexual contact, abusive sexual contact, forcible sodomy (oral or anal sex), or attempts to commit any of these acts.  

Consent- words or overt acts indicating a freely given agreement to the sexual conduct at issue by a competent person. An expression of lack of consent through words or conduct means there is no consent. Lack of verbal or physical resistance or submission resulting from the accused’s use of force, threat of force, or placing another person in fear does not constitute consent. A current or previous dating relationship by itself or the manner of dress of the person involved with the accused in the sexual conduct at issue shall not constitute consent. There is no consent where the person is sleeping or incapacitated, such as due to age, alcohol or drugs, or mental incapacity.

107th Attack Wing Sexual Assault Prevention and Response: Sexual Assault Response Coordinators (SARCs) and Victim Advocates are available to assist victims (survivors) of sexual assault. The 107th Attack Wing SARCs serve as points of contact for integrating and coordinating sexual assault victim (survivors) care for members of the 107th ATKW, 222nd CACS and 274th ASOS. The SARC office is also responsible for providing Sexual Assault Prevention training throughout the Wing.
